Unexpected Items: 9 provisions
These provisions fall outside the bill’s main subject or apply narrowly. This describes the text; it is not a judgment.
Not related to the bill’s main subject (3)
- Sec. 14: Study on non-payment stablecoins: Requires the Secretary of the Treasury to study non-payment stablecoins, including endogenously collateralized payment stablecoins, and report findings within 365 days of enactment.
- Sec. 16: Authority of banking institutions: Bars federal banking agencies, the National Credit Union Administration and the Securities and Exchange Commission from requiring certain institutions to put digital assets held in custody on their balance sheets or to hold regulatory capital against them, with an exception for operational risk.
- Sec. 19: Disclosure relating to payment stablecoins: Amends section 13104(a)(3) of title 5, United States Code, to add payment stablecoins issued by a permitted payment stablecoin issuer aggregating $5,000 or less to the items listed in that paragraph. ($5,000)
Exception or delay for a subset (6)
- Sec. 4: Requirements for issuing payment stablecoins: Subsection (g) says a Federal savings association that holds a reserve meeting section 4(a)(1) is not required to satisfy the qualified thrift lender test under the Home Owners' Loan Act for those reserve assets.
- Sec. 5: Approval of subsidiaries of insured depository institutions and Federal qualified payment stablecoin issuers: Subsection (f) lets the primary Federal regulators waive the Act's requirements for up to 12 months from the effective date for issuers that have an application pending on that date.
- Sec. 3: Issuance and treatment of payment stablecoins: Section 3 does not apply to three kinds of transactions: direct transfers between two individuals without an intermediary, transfers between an individual's own U.S. and foreign accounts at the same parent company, and transactions through a software or hardware wallet for the individual's own custody.
- Sec. 6: Supervision and enforcement with respect to Federal qualified payment stablecoin issuers and subsidiaries of insured depository institutions: Federal supervision and enforcement apply to permitted issuers that are not State qualified issuers with consolidated total outstanding issuance under $10,000,000,000, and the enforcement subsection states it does not apply to a State qualified payment stablecoin issuer. ($10,000,000,000)
- Sec. 10: Custody of payment stablecoin reserve and collateral: The custody requirements do not apply to persons that only provide hardware or software for a customer's own custody. Another provision allows omnibus commingled accounts at certain institutions and lets insured depository institutions hold reserves as cash on deposit.
- Sec. 18: Exception for foreign payment stablecoin issuers and reciprocity for payment stablecoins issued in overseas jurisdictions: Exempts foreign payment stablecoin issuers from the Section 3 prohibitions if they meet listed conditions, including supervision by a regulator in a country or named U.S. territory whose regime Treasury finds comparable, registration with the Comptroller, and U.S. reserves.
What it does
- Sec. 3: Makes it unlawful for any person other than a permitted payment stablecoin issuer to issue a payment stablecoin in the United States, and sets a fine of not more than $1,000,000 for each violation, up to 5 years in prison, or both for knowing participation.
- Sec. 4: Requires a permitted payment stablecoin issuer to keep identifiable reserves backing its outstanding payment stablecoins on an at least 1 to 1 basis, made up of listed assets such as U.S. currency, insured deposits and Treasury bills, notes, or bonds of 93 days or less.
- Sec. 4: Requires issuers to publicly disclose a redemption policy with procedures for timely redemption and all fees, and to publish the monthly composition of their reserves on the issuer's website.
- Sec. 4: Allows a State qualified payment stablecoin issuer with consolidated total outstanding issuance of not more than $10,000,000,000 to opt for a State-level regulatory regime that is substantially similar to the Federal framework.
- Sec. 5: Requires each primary Federal payment stablecoin regulator to review applications to issue payment stablecoins and to decide each substantially complete application within 120 days, with an application deemed approved if no decision is made in that time.
- Sec. 7: Gives a State payment stablecoin regulator supervisory, examination, and enforcement authority over all State qualified payment stablecoin issuers of that State.
- Sec. 11: Gives holders of a permitted issuer's payment stablecoins priority over other claims against the issuer with respect to required reserves in an insolvency proceeding, and amends title 11 of the United States Code to carry this out.
- Sec. 17: Amends the Investment Advisers Act of 1940, Investment Company Act of 1940, Securities Act of 1933, Securities Exchange Act of 1934, and Securities Investor Protection Act of 1970 so that "security" does not include a payment stablecoin issued by a permitted issuer.
- Sec. 18: Exempts a foreign payment stablecoin issuer from the section 3 prohibitions if the Treasury Secretary finds its country's regime comparable, it is registered with the Comptroller, and it holds sufficient reserves in a United States financial institution.
- Sec. 20: Sets the effective date as the earlier of 18 months after enactment or 120 days after the primary Federal payment stablecoin regulators issue any final regulations implementing the Act.
